Know your options following a DUI arrest

You didn’t think you had that many. You swore you were fine to drive.

Then you were pulled over and blew a high enough BAC reading to be charged with a DUI. What now?

Pennsylvania has three tiers when it comes to DUI enforcement, with punishments that increase the higher your BAC is at the time of arrest.

All three assume this is your first DUI:

The first tier

From .08 to .099 BAC this DUI charge carries the lightest sentence guidelines of the three. These DUIs call for no minimum jail time and a $300 fine. The judge may not suspend your driver’s license.

The second tier

If your BAC registers .10 to .159, penalties include 48 hours to six months in prison and/or a $500 to $5,000 fine. This tier also includes a 12-month suspension of your license.

The third tier

If your BAC registers .16 or higher, penalties include 72 hours to six months in prison and/or $1,000 to $5,000 in fines. It includes a 12-month suspension of your license.

There are several things you can do to fight a DUI charge, including:

  • Challenging the results of a breathalyzer
  • Examining probable cause for being pulled over
  • Disputing the accuracy of any blood tests
  • Using witnesses to dispute police testimony

These are just a few examples of ways that you can challenge a DUI conviction. There are multiple factors that the government must take into account when bringing a DUI case to court.
